Official Rules (“Official Rules”)

NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING. BY ENTERING, YOU AGREE TO THESE OFFICIAL RULES, WHICH ARE A CONTRACT, SO READ THEM CAREFULLY BEFORE ENTERING. WITHOUT LIMITATION, THIS CONTRACT INCLUDES INDEMNITIES FROM YOU AND A LIMITATION OF YOUR RIGHTS AND REMEDIES.

By entering into this Sweepstakes, I fully and unconditionally accept the terms and conditions set forth in these Official Rules and agree to Sponsor’s decisions, which are final and binding. I confirm I am at least 21 years old and have reached the age of majority in my jurisdiction of residence at the time of opt-in. Winning a prize is contingent upon fulfilling all requirements set forth herein. The Sweepstakes is subject to federal, state, municipal, and local laws and regulations and is void where prohibited. (New Jersey Notice: This Sweepstakes is not void in New Jersey).

Eligibility: The Food Network South Beach Wine & Food Festival presented by Capital One sweepstakes is open to anyone who is at least twenty (21) years of age and has reached the age of majority in their jurisdiction of residence at the time of opt-in and lives within the continental United States and has a valid email address. Employees, independent contractors, interns, officers, directors, and agents of Sponsor and the associated companies are not eligible to enter. An AAdvantage account is required to claim the miles portion of the Prize.  If Winner is not an AAdvantage® member, they may join at no cost online at www.aa.com/loyalty/enrollment/enroll or by calling the AAdvantage® membership desk at 1-800-882-8880. Sponsor: The Sweepstakes is sponsored by Food Network South Beach Wine & Food Festival presented by Capital One.

Entry Period: The Sweepstakes begins at 9:00am EDT on 12/1/2023 and will end on 2/5/2024 at 11:59PM EDT (the “Entry Period”). Entries submitted before or after the Entry Period will not be eligible. Sponsor’s computer is the official timekeeping device for the Sweepstakes. 

How to Enter: At the beginning of the Entry Period, you may enter the Sweepstakes by visiting the sweepstakes site (the “Sweepstakes Site”) and completing the Sweepstakes entry form. There is a limit of one (1) entry per person/email address (not including “Bonus Entries,” as described below). Additional entries per person/email address, excluding “Bonus Entries” will not be acknowledged. The use of an agency or any automated system to enter is strictly prohibited and Sponsor reserves the right to disqualify any entries received through such methods, as determined by Sponsor, in its sole discretion. There is NO PURCHASE OR PAYMENT OF ANY KIND NECESSARY to participate in the Sweepstakes. A purchase does not improve your chance of winning. 

Drawing: After the Entry Period, on or about 2/5/2024, Sponsor will select 1 potential winner in a random drawing of all entries received. The odds of being selected depend on the number of entries received.

Notification and Requirements of Potential Winners: Sponsor will attempt to notify potential winner within three (3) business days of the drawing by email provided by an Entrant in an entry form. If a potential winner does not respond within 48 hours after the notice is sent, or if a winner rejects his/her prize or in the event of noncompliance with these Sweepstakes rules and requirements, the Sponsor will select an alternate potential winner in his/her place at random from all remaining entries received. Only two (2) alternate potential winners will be contacted. Except where prohibited, a potential winner may be required to complete and return an affidavit of eligibility and liability/publicity release. If a potential winner fails to sign and return these documents within the required time period, an alternate potential winner may be selected in his/her place in a random drawing of all remaining entries received. Only two (2) alternate potential winners may be contacted.

Prize(s): One (1) grand prize will be awarded, and one (1) winner will be chosen.

Two (2) Tickets to four (4) Food Network South Beach Wine & Food Festival presented by Capital One events

Two (2) AAdvantage® Miles certificates for 30,000 miles each to be used towards applicable air transportation.  

Two (2) night, single-occupancy stay at the Fontainebleau’s Miami Beach’s newly renovated Chateau Tower 

Prize(s)’ Conditions: SOBEWFF® event tickets are redeemable only for the events assigned and are not exchangeable for other events or cash value. Any tickets not redeemed will be forfeited upon conclusion of each event. All events are subject to availability. Substitutions are valid at the Sponsor’s sole discretion. Hotel stay is only valid for dates issued and are subject to availability. Sponsor reserves the right to substitute another property, at their sole discretion. Hotel stay does not include taxes, fees, room service, gratuity, or incidental expenses. Additional nights at the Hotel are the sole responsibility of the prize winner. Timing, location, and other relevant details of the chef meet and greet will be at the festival’s discretion. A Festival representative will accompany the winner to the event. Airfare credit valid toward domestic travel and does not include baggage and handling fees, seat upgrades, taxes, fees, or any additional expenses incurred during travel. Sponsor will make every reasonable attempt to accommodate prize winner. Winner and travel companion must travel on same itinerary. Winner and travel companion must have valid photo ID and any other required documentation. Prize must be used on dates specified or prize will be forfeited.  Travel non-transferrable. Dates are subject to change.

If weather affects the ability for winner and his/her guest to redeem any portion of prize during the scheduled date and time, then the Sponsor shall have no further obligation to the winner and/or guest other than to supply the remaining elements of the prize package minus the unused portion of prize. If for any reason whatsoever, winner and/or guests are unable to travel after all travel arrangements have been made and paid, the Sponsor shall have no further obligation to the winner. In the event Grand Prize winner's home is in close enough proximity to trip destination, Sponsor may determine in its sole discretion that a flight is unnecessary, and the prize will not include air transportation and no other substitution or compensation will be provided in lieu thereof. 

AAdvantage miles are subject to the following additional terms and conditions:

If AAdvantage® miles are redeemed for air transportation, the following additional terms and conditions apply. Winner is responsible for the full cost of transportation to and from their departure and arrival city.  Winner is responsible for any and all applicable fees, service charges, surcharges or passenger facility charges and all insurance costs, federal, state, local and foreign taxes, if any, gratuities, meals, incidentals, and any other unspecified expenses associated with acceptance or use of the Grand Prize.  AAdvantage® flight awards are subject to, and the Sponsor will be responsible for, the September 11th Security Fee of $5.60 per one-way trip, per passenger, applicable departure taxes, federal inspection fees, passenger facility charges of up to $18.00, depending on itinerary, and any other taxes and fees imposed by a government entity (U.S. or foreign) of up to $240 based on destination; total may vary slightly based upon currency exchange rate at time of purchase, as well as any fees or surcharges (including fuel surcharges) imposed by the carrier. U.S. government excise tax is a user tax to pay for airport construction and airway safety and operations.  If ticketing is less than 21 days prior to departure, Sponsor will be responsible for a $75.00 expedite charge will apply (waived for AAdvantage® Executive Platinum, AAdvantage® Platinum and AAdvantage® Gold members using miles from their account).  The Sponsor will also be responsible for a ticketing service charge of up to $40.00 will apply when ticketing via Reservations, American Airlines Travel Center or an Airport Ticket Office.  (The ticketing service charge is waived for involuntary changes, reissued tickets, AAdvantage® award tickets issued within 21 days of travel and an expedite charge has been collected, AAirpass® tickets, Government/military fare tickets, and prepaid tickets.)  Some of these taxes, fees and other amounts may be due upon booking/ticketing the AAdvantage® award travel.  

American Airlines AAdvantage® miles will be credited to the AAdvantage® account of Winner or may be provided in the form of a Certificate as set forth below, who must provide a valid AAdvantage® membership number in order to receive the mileage credit. American Airlines AAdvantage® miles awarded in this Contest will not count toward elite status qualification, AAdvantage Million Miler^sm status or any other promotional benefit that American Airlines may offer in the AAdvantage® program.  Winners who are not AAdvantage® members may join at no cost online at www.aa.com and click on AAdvantage® or by calling the AAdvantage® membership desk at 1-800-882-8880.  The credited miles may thereafter be redeemed in any manner consistent with the AAdvantage® program Terms and Conditions, which are subject to change at any time without notice and can be found at www.aa.com/aadvantage when you click on Program Details and then click on AAdvantage® Terms and Conditions.  Determination of income tax liability on AAdvantage® travel awards is the responsibility of the Winner.  American Airlines may, among other things, (i) withdraw, limit, modify, or cancel any award; (ii) change program benefits, mileage levels, participant affiliations, conditions of participation, rules for earning, redeeming, retaining or forfeiting mileage credit, or rules for the use of travel awards; or (iii) add travel embargo dates, limit the number of seats available for award travel (including, but not limited to, allocating no seats on certain flights) or otherwise restrict the continued availability of travel awards or special offers.  American Airlines reserves the right to change the AAdvantage® program and its terms and conditions at any time without notice, and to end the AAdvantage® program with six months’ notice.  American Airlines may make any one or more of these changes at any time even though such changes may affect your ability to use the mileage credit or awards that you have already accumulated.  AAdvantage® travel awards, accrued mileage credits and special offers are subject to government regulations.  American Airlines is not responsible for products and services offered by other participating companies.  For complete AAdvantage® program details, visit www.aa.com/aadvantage. 

Neither Sponsor nor American Airlines or its Airline Associates are liable for any expense incurred as a consequence of a flight cancellation or flight delay. Travel is subject to availability and certain other restrictions, which are subject to change in the sole discretion of Sponsor.  Flight schedules subject to change without notice.  If AAdvantage® miles are sent to the Winner in the form of a Certificate:  Certificate is not redeemable for cash.  Certificate may not be transferred, purchased, sold or bartered. Only original Certificates will be honored.  Certificate is void if reproduced, altered, counterfeited, obtained or used improperly.  Lost, stolen, damaged or destroyed Certificates will not be replaced by American Airlines.  Determination of income tax liability on mileage Certificates and AAdvantage® travel awards is the responsibility of the holder.  The holder of the Certificate has only the limited right to surrender same to American Airlines in accordance with rules and conditions stated herein for crediting of mileage by American Airlines and subject to all AAdvantage® Terms and Conditions.  Certificate must be deposited online at www.depositAAmiles.com to the AAdvantage® account of Winner.  Mileage credit can be deposited only once on or before the expiration date.  AAdvantage® travel awards, accrued mileage credits and special offers are subject to government regulations.  For complete deposit AAmiles program details, visit www.depositAAmiles.com.  For complete AAdvantage® program details, visit www.aa.com/aadvantage.

Offer based on availability and blackout dates apply including holidays and seasonal dates. Additional room categories and suites may be available, at higher rates. Published rate is subject to availability and subject to change without notice. Offer may be discontinued at any time without notice. Offer cannot be combined with any other discount, and is not applicable to groups. Resort credit is once per stay, has no cash value, and must be used during duration of hotel reservation. Resort credit may not be used towards the hotel fees or room rate. Restaurant and spa availability is limited and reservations are highly recommended prior to arrival.

Additional Conditions: In the event that the operation, security, or administration of the Sweepstakes is impaired in any way for any reason, including, but not limited to fraud, virus, or other technical problem, Sponsor may, in its sole discretion, either: (a) suspend the Sweepstakes to address the impairment and then resume the Sweepstakes in a manner that best conforms to the spirit of these Official Rules; or (b) award the prize(s) at random from among the eligible entries received up to the time of the impairment. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Failure by Sponsor to enforce any term of these Official Rules shall not constitute a waiver of that provision. Proof of sending any communication to Sponsor by mail shall not be deemed proof of receipt of that communication by Sponsor. In the event of a dispute as to any online entry, the authorized account holder of the email address used to enter will be deemed to be the participant. The “authorized account holder” is the natural person who is assigned to an email address by an Internet access provider, online service provider, or other organization responsible for assigning email addresses for the domain associated with the submitted email address.

Release and Limitations of Liability: By participating in the Sweepstakes, you agree to release and hold harmless Sponsor, the Associated Companies,  their parents, subsidiaries, affiliates, the prize providers and each of their respective officers, directors, employees, and agents (the “Released Parties”) from and against any claim or cause of action arising out of participation in the Sweepstakes or receipt or use of any prize, including, but not limited to: (a) unauthorized human intervention in the Sweepstakes; (b) technical errors related to computers, servers, providers, or telephone, or network lines; (c) printing errors; (d) lost, late, postage due, misdirected, or undeliverable mail; (e) errors in the administration of the Sweepstakes or the processing of entries; or (f) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Sweepstakes or receipt or use of any prize. You further agree that in any cause of action, the Released Parties’ liability will be limited to the cost of entering and participating in the Sweepstakes, and in no event shall the Released Parties be liable for attorney’s fees. You waive the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.

Privacy and Use of Information Submitted; Publicity: Any information you submit as part of the Sweepstakes will be used for purposes of the Sweepstakes and as provided in these Official Rules and treated in accordance with Sponsor’s Privacy Policy as otherwise set forth in these Official Rules. Except where prohibited, participation in the Sweepstakes constitutes an entrant’s consent to Sponsor’s use of his/her name, likeness, voice, opinions, biographical information, and state of residence for promotional purposes in any media without further payment or consideration.

Use of Entrant Information: By entering the Sweepstakes, you acknowledge and agree that Sponsor and the Associated Companies will use Entrant’s information, including, without limitation, your email address, phone number, mailing address, or any other contact information provided for general solicitation, marketing, or other business or promotional activities in connection with the services and products provided by Sponsor or the Associated Companies. You may at any time revoke the use of such information by providing written notice to Sponsor and each other participating company by responding to a marketing email using the unsubscribe link provided in the email. Please note that your opt-out preference will apply to marketing communication and may not apply to transactional communication including those associated with your entry. 

Disputes: Except where prohibited, you agree that any and all disputes, claims and causes of action arising out of, or connected with, the Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in {{Miami-Dade County}. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, your rights and obligations, or the rights and obligations of Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of Florida, without giving effect to any choice of law or conflict of law rules (whether of State of Florida or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than State of Florida.

Third Party Platforms: If this Sweepstakes is hosted, administered, or operated on a third party platform, including without limitation a social media platform (e.g. Facebook or Twitter) (“Third Party Platform”), then by participating in this Sweepstakes, entrants hereby release and agree to comply with all rules and policies set forth by such Third Party Platform and to hold harmless such Third Party Platform from any and all liability, loss or damages arising from or in connection with the awarding, receipt, and/or use or misuse of prizes or participation in any prize related activities. Unless otherwise stated to the contrary in these Official Rules, this Sweepstakes is not sponsored, endorsed or administered by, or associated with, any Third Party Platform.

Results: To request a winners list, send a self-addressed, stamped envelope to Food Network South Beach Wine & Food Festival presented by Capital One, Florida International University c/o South Beach Wine & Food Festival HQ, 2105 N. Miami Avenue, Miami, FL. Requests must be received within four (4) weeks of the end of the Entry Period.
